The Challenge of Positive Drug Tests in the Workplace for Employers
Positive drug tests are a perfect example of where a positive is truly negative in the workplace. For employers, positive drug tests often put them between a proverbial rock and a hard place. When a valuable employee tests positive for drugs, what do you do next as an employer?
As an integrated healthcare provider of substance use disorder (SUD) treatment services, Tarzana Treatment Centers (TTC) understands the challenge of positive drug tests in the workplace.
Suddenly, there are so many questions that need to be addressed.
- Should an employee be fired after a positive drug test?
- Should the employee be given another chance after a first failed test?
- Is there an employee assistance program to help the employee?
- Do the employee’s work history and value matter in such a decision?
Positive Drug Tests and Employer Consistency
From the perspective of employment attorneys, consistency is the key. Thus, a drug policy must be in place if a company drug tests employees. In addition, this drug policy needs to be a part of the company’s employee handbook. By having a drug policy before a positive drug test, an employer knows the next steps.
According to the Substance Abuse and Mental Health Services Administration (SAMHSA), “Drug testing is a prevention and deterrent method that is often part of a comprehensive drug-free workplace program. Any workplace drug-testing program, Federal and non-federal, should comply with applicable local, state, and federal laws.”
Without question, all workplaces should be drug-free. However, all workplaces do not fall under the same external guidelines. Therefore, employers must follow applicable local, state, and federal laws.
Regarding a failed drug test, there is no reason to let an emotional reaction injure a company. Although compassion is a positive emotional response, it is just as likely that an employer will be angry and hostile. Whether positive or negative, emotions are not the proper response and should not be the basis of decision-making.
Employer Consistency and the Value of Promoting Recovery
A consistent employer understands the value of a good employee. Hence, when an employee falters, a consistent employer will help that person get back on track. In 2022, Tarzana Treatment Centers celebrates the nonprofit organization’s 50th anniversary. For many years, our recovery experts have been helping employers by offering cost-effective treatment for their employees.
As a direct result, a positive test often means opening the door to recovery. Employers find a workable solution by offering employees a respected SUD treatment program that works with almost all insurance providers. Indeed, a proven history at TTC exists of helping people get back to work.
Once positive, drug tests led to doors closing and employees losing jobs. Today, positive drug tests often open doors where recovering employees improve their performance upon returning to work. Please contact us today to learn more about the SUD treatment program at TTC.
